Estate of Deckman v. Joseph

2026-Ohio-1968 (8th Dist. 2026) · Court of Appeals of Ohio, Eighth Appellate District, Cuyahoga County · May 28, 2026 · No. 115371

Summary

The Ohio Eighth District Court of Appeals reviewed the dismissal of claims arising from alleged misuse of powers of attorney to change life-insurance beneficiaries and alter estate planning. The court held that prior dismissals for lack of standing, failure to join necessary parties, and lack of subject-matter jurisdiction were not adjudications on the merits for res judicata purposes. It affirmed dismissal of the constructive-trust and accounting counts as independent causes of action, but held that those remedies could remain available for surviving claims, including undue influence and breach of fiduciary duty, and remanded the case.

Holdings

  1. The prior probate and federal dismissals were not final judgments on the merits because they were based on lack of standing, failure to join necessary parties, and lack of subject-matter jurisdiction. Accordingly, those dismissals did not bar the current action under res judicata, and summary judgment was improper on that basis.
  2. The argument that the current action should be dismissed because Deckman I was still pending was moot because this court had resolved Deckman I and had not remanded it to the probate court.
  3. The trial court erred in dismissing the undue-influence claim. The defendants' asserted basis for dismissal—that monetary damages were not an available remedy—did not warrant dismissal because the complaint also sought equitable relief through a constructive trust, and defendants did not establish that plaintiffs could prove no set of facts entitling them to relief.
  4. The trial court properly dismissed the constructive-trust and accounting counts as independent causes of action, but those remedies remain available for claims that remain pending.
  5. A trial court need not set forth detailed reasoning in an opinion granting summary judgment; therefore, the second assignment of error was overruled.

Questions Presented

  1. Whether the trial court erred in granting summary judgment on the ground that the claims were barred by res judicata.
  2. Whether dismissal was proper because the prior probate appeal was pending.
  3. Whether the trial court properly dismissed the undue-influence claim for failure to state a claim.
  4. Whether constructive trust and accounting claims were properly dismissed as independent causes of action.
  5. Whether the trial court was required to provide detailed reasoning in an opinion granting summary judgment.
