NORTH FLA. WOMEN'S HEALTH SERVICES v. State

866 So. 2d 612 · Fla. · July 10, 2003

Summary

The Supreme Court of Florida held that the Parental Notice of Abortion Act, section 390.01115, Florida Statutes (1999), violated the Florida Constitution's right to privacy. Applying In re T.W., the court concluded that the Act imposed a significant restriction on a minor's privacy rights and did not further a compelling state interest through the least intrusive means. The court quashed the First District's decision and approved the trial court's ruling enjoining enforcement of the Act.
