Summary
The Kentucky Supreme Court holds that in a felony trial, the jury must not be instructed during the guilt phase on the penalty ranges for either the charged felony or lesser included offenses. If the jury instead convicts the defendant of a lesser included misdemeanor, the court must then instruct the jury on the applicable penalty range and conduct a separate punishment phase. The court certifies the law and reverses the procedure used in Gregory Ross Philpott’s trial.
