John and Vanessa Doe failed to state negligence-related claims against Meschery because they did not adequately allege a special relationship or independent duty owed directly to them, did not witness the abuse, and did not allege that Meschery knew of the abuse in time for the parents to take protective measures.
  5. The motion to strike the punitive-damages request was granted as to the District and denied as to Meschery. The District defendants did not show specific undue prejudice from the request as to Meschery, while punitive damages could not be recovered against the public entity.
  6. Shaffer's counsel was permitted to withdraw because counsel showed good cause and complied with the applicable local-rule notice requirements, and Shaffer consented to withdrawal.
