Matter of Ryan

2025 NY Slip Op 25016 · Surrogate's Court, Monroe County · January 24, 2025 · No. File No. 2024-2421

Summary

This Surrogate's Court opinion addresses a petition to determine whether a nominated executor is ineligible to serve due to improvidence or unfitness under the Surrogate's Court Procedure Act. The court found that the nominated executor's eighteen-month delay in filing for probate, combined with her retention of estate proceeds contrary to the decedent's will and lack of credible justification, rendered her unfit to administer the estate. Consequently, the court denied the petition for letters testamentary and granted letters of administration cta to the competing petitioner.

Key quotations

The power of the surrogate to refuse letters is limited by statute. If qualified one named as executor is entitled to the issuance of letters . . . 'The testator . . . enjoys the right to determine who is most suitable among those legally qualified to settle his affairs and execute his will, and his solemn selection is not lightly to be disregarded'
[a] nominated executor's character failings may be offensive to others, but unless they, in the aggregate, clearly demonstrate unworthiness for the responsibilities to be undertaken, they cannot bar the appointment

Factual background

Niss Ryan died on April 4, 2023 leaving a will that named her stepdaughter Barbara Pilcher as executor. Barbara failed to file a petition to probate the will for nearly 18 months, sold two Mexican condominiums and kept the proceeds, and did not distribute the estate assets to the residuary beneficiaries. Susan Houde-Walter, the decedent’s daughter, filed petitions for letters of administration and to compel production of the will.
